EMPLOYEE DETAILS:
Three full time employees (excluding owner) identified as: senior paralegal, paralegal, and receptionist/legal assistant. Two part-time paralegals remunerated as independent contractors.
Employees are stable, but when the need arises for replacements, the law firm has often hired former clients who have proven to be excellent employees and supremely reliable;
Owner considers himself vastly knowledgeable about immigration and nationality law, case law, statutory and regulatory law, and procedure, and is willing to train his successor, and be considered “of counsel” on the firm’s website and letterhead for an agreed period of time. Owner is willing to still handle some court hearings in the future on a per diem basis. Owner is willing to be employed by the successor post-sale for a reasonable period of time;
Successor needs to be a member of any Bar Association of a U.S. State or Possession, in good standing. This legal practice is federal in nature. The successor will have be admitted to practice before the Immigration Courts and Board of Immigration Appeals which means an identity number issued by the Executive Office for Immigration Review (“EOIR”) and an internet account for filings under “ECAS.” The successor will have to secure identity numbers with the U.S. Citizenship and Immigration Services (“USCIS”) and Immigration and Customs Enforcement (“ICE”), the latter for internet filings under “ICE E-Service.” It is highly recommended that the successor join the American Immigration Lawyers Association (“AILA”) including the South Florida and Central Florida chapters. It is also highly recommended that the successor joins the Bar Associations of the U.S. District Courts for the Southern and Middle Districts of Florida;
Presuming the successor has limited to no knowledge of immigration and nationality law, I expect the learning curve to be 6-12 months.
